Terms of Service

These Terms govern your use of the onTour platform operated by onTour Technologies Inc. By accessing or using onTour, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What onTour Does

onTour is a demand intelligence and alert service for the live events market. We monitor tour announcements, ticket availability, on-sale dates, and market conditions — and surface that information to help you make better decisions about where, when, and how to pursue tickets. We do not sell tickets. We are not a ticketing platform.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

3. Your Account and Preferences

onTour does not require a traditional username/password account. Your preferences — including your home market, travel range, budget tier, followed artists, and notification settings — are stored locally on your device and, if you opt in to push notifications, associated with your push subscription on our servers.

You are responsible for keeping your device secure. We are not liable for unauthorized access to your preferences or notification settings resulting from your failure to maintain device security.

4. Push Notifications and Alert Consent

By enabling push notifications, you expressly consent to receive alert messages from onTour. These alerts may include:

You may withdraw this consent at any time by disabling push notifications in your device or browser settings, or by contacting us at the address below. We will process opt-out requests within 10 business days. Withdrawal of consent does not affect the lawfulness of notifications sent before withdrawal.

We will not send you unsolicited commercial promotions from third parties via push notification.

Third-Party Data: Publicly available ticketing and event data sourced from licensed APIs (including Ticketmaster Discovery API) and publicly accessible sources.

5.2 What We Do Not Collect

We do not collect your name, email address, phone number, payment information, or government-issued identifiers unless you voluntarily provide them (e.g., when contacting support). We do not collect or store precise real-time location data.

7. Data Ownership, Aggregation, and Licensing

7.1 Your Personal Data

You retain ownership of the personal information you provide to onTour. We do not sell your individually identifiable personal data to third parties. We do not share your push subscription endpoint, profile preferences, or individually attributed behavioral data with any third party for their independent marketing or targeting purposes.

7.2 Derived Intelligence and Aggregated Data — Company Ownership

By using the Service, you grant onTour a perpetual, worldwide, royalty-free, sublicensable license to use, process, and incorporate your anonymized, de-identified usage data into aggregated market intelligence products, datasets, and analytical outputs.

Aggregated and de-identified data ("Derived Intelligence") includes, by way of example:

Derived Intelligence does not identify you personally and cannot reasonably be used to re-identify you. onTour owns all Derived Intelligence and all intellectual property in products built from it, including B2B data feeds, market reports, and demand analytics licensed to industry partners.

7.3 What This Means in Practice

You use onTour for free. The commercial value that enables us to build and maintain the platform comes from the Derived Intelligence layer — anonymized, aggregated demand signals that help the broader live events industry understand where fan intent is concentrated. No individual user's data is exposed, profiled, or monetized individually. The data product is statistical in nature.

If this model is unacceptable to you, do not use the Service.

7.4 No Sale of Personal Data

onTour does not sell personal data as defined under applicable privacy laws, including the California Consumer Privacy Act (CCPA) and substantially similar state laws.

8. Data Retention and Deletion

We retain profile and behavioral data associated with your push subscription for as long as your subscription is active plus 24 months. Push subscriptions that fail delivery for 90 or more consecutive days are automatically expired and their associated data deleted.

To request deletion of your data, contact us at the address in Section 16. We will process verified deletion requests within 30 days.

9. Security

We implement commercially reasonable technical and organizational measures to protect data in transit and at rest, including TLS encryption for all API communications and encrypted push payload delivery per RFC 8291. No security system is impenetrable. We will notify affected users of any breach of unencrypted personal data as required by applicable law.

10. Third-Party Services

The Service integrates with third-party services including ticketing APIs and web push delivery infrastructure. These third parties operate under their own terms and privacy policies. onTour is not responsible for the practices of third-party services.

We use Cloudflare infrastructure for application delivery and data storage. Cloudflare's privacy policy is available at cloudflare.com/privacypolicy.

11. Intellectual Property

All software, algorithms, scoring logic, design, trademarks, and content comprising the onTour Service — including but not limited to the demand signal engine, personalization ranking system, and market intelligence methodology — are the exclusive property of onTour Technologies Inc. and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. You may not reverse engineer, copy, distribute, or create derivative works from any component of the Service.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING ACCURACY OF MARKET INTELLIGENCE, TICKET AVAILABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. TOUR AND TICKETING INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE. onTour IS NOT RESPONSIBLE FOR PURCHASING DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH THE SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, onTour'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED $100 CAD. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes shall be resolved by binding arbitration in Toronto, Ontario, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

15. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via in-app notice or push notification (if you are subscribed). Continued use of the Service after the effective date of updated Terms constitutes acceptance.
